Mr. MacKay is available for court-referred arbitrations for various Superior Courts throughout Southern California.  Fees to be paid by participants, if any, are set by local court rules.

If you have been referred to Mr. MacKay for Arbitration or other ADR process, please immediately email or fax the
following:

1. At least three dates available on your calendar for the hearing;

2. The arbitration return date and the final date for the arbitration hearing to take place;

3. Conflicts information, including the names of all parties, handling attorneys, and key witnesses;

4. Full case name, case number, court (a caption page will suffice);

5. The email address and/or fax number which you agree Mr. MacKay may use, in lieu of mail or personal service, to communicate and serve notices upon you and your client for the duration of the Arbitration or other ADR process, including any post-hearing matters including the award.  The award will always be mailed in addition to any electronic delivery.  This agreement does not affect the rights and/or obligations between the parties regarding time, place, or manner of service; it is merely a convenience to Mr. MacKay as Arbitrator or Neutral.

6. If this is an Arbitration referral, whether the parties have agreed to Non-Binding or Binding Arbitration.

Please reserve detailed case information for your briefs and/or the hearing.  Following a conflicts check, an informal case summary (less than one page in length) may be requested of the participants to determine the necessity of formal briefing.

Mr. MacKay is available for private arbitration, settlement conference, and private discovery master services at an aggregate rate of $300 per hour.  Typically, the fee is divided equally among the participating parties.

A minimum of three (3) hours applies in simple cases, the fee for which must be deposited in advance of the first hearing.  An invoice for additional time, if any, will be provided to the participants at a later date.

Complex matters may require a higher minimum and a replenishing retainer.
